EU REGULATIONS ON SUCCESSION LAWS FOR OVERSEAS PROPERTY 

New regulations came into force on 17 August 2015   and it is most important that anyone with property in another country review their Wills and estate planning to avoid the forced inheritance laws of many of the EU countries.

A new legally valid UK Will drafted to comply with either English or Scottish law is now effective for overseas EU property in accordance with these new EU regulations. Therefore a new UK Will that complies with these new regulations mean it is not now necessary to have a local 

Will to cover foreign property.

Make a Will in Spain

Legal Will Writers in Spain offer a Will Writing service for UK  Expats who are living in Spain and want to make a UK Will to comply with either English or Scottish laws of succession without having to make a return visit to the UK. 

Since January 2021 Spanish Expat residents need separate Wills for both Spain and the UK. We are qualified to write your new Will under either English/Welsh Law or the Scottish Laws of Succession which are quite different.

Executors 

Under UK law you do not need to appoint ´legal professionals´ to act as an executor or trustee of your estate, unless there is a likelihood of a complex Trust arising. Professional executors will charge your estate to act, and in many cases, for duties that a layperson could have done.

A power of attorney is a document appointing someone to act for the granter and to make decisions on behalf of the granter. The person who grants the power is called the 'granter' and the person appointed is known as the 'attorney'.

Anyone concerned to make plans for the future should consider making a power of attorney. A power of attorney can be useful both for someone anticipating the chance of a permanent incapacity or to deal with periods of incapacity in the future.
